Terms of Use

In short

1. Provider and scope of application

The provider is Raphael Boullet, Hohentwielstraße 108, 70199 Stuttgart, Germany, email: kontakt@vokabelchampion.app. Vokabel-Champion is a private, non-commercial service. These terms and conditions apply to the app (in the browser and as an Android app), the account, class and parent accounts, and the website vokabelchampion.app, including the Academy.

2. What Vokabel-Champion offers

Vokabel-Champion is a vocabulary trainer with game elements: listening and writing exercises, boss battles, flashcards, missions, medals and a robot with a shop. It also features classes with leaderboards, a parents’ account with a simple overview, the option to import your own vocabulary (including via photo, which is only read on your device) and support for multiple languages. It’s free to use.

The available features are subject to change. We are continuing to develop the app and may change, replace or remove features.

3. Account and access

To use the app, you create an account with a username and password. Providing a parent’s email address is optional. The name used in the app does not have to be a real name; we recommend using a nickname.

Children under the age of 16 require their parents’ consent. This is confirmed during registration. Parents are responsible for ensuring that their child uses the app sensibly and safely.

Please keep your password and recovery code confidential and do not share them with anyone else. Provide accurate details when registering. If you believe that someone else has access to your account, please contact us.

4. Classes and leaderboard

Teachers can create a class and provide vocabulary for all members. Members join using a class code. In a class’s leaderboard, members can see each other’s names in the app and their scores. There is no chat or messaging function between children.

Teachers are responsible for ensuring that use of the app in class is agreed with their school and that the vocabulary provided does not infringe the rights of third parties.

5. User-generated content and permitted use

You can enter your own vocabulary, set names and a name within the app. This content must not be offensive, discriminatory, harmful to minors or otherwise unlawful, and must not infringe the rights of third parties, such as copyright or personal rights. When importing via file or photo, you must only take photos of or upload lists that you are permitted to use for learning purposes.

Text recognition when importing photos may make mistakes. Please check the recognised vocabulary against your list and correct it before accepting it.

It is not permitted to attempt to disrupt the app, take over other users’ accounts, circumvent security measures or automatically extract data from the app. If anyone breaches these terms and conditions, we may remove content and suspend or delete the account.

6. Rights to the app

The texts, graphics, the robot and the Vokabel-Champion software are protected by copyright. You are granted a simple, non-transferable right to use the app for learning within the family or in class. Any use, reproduction or distribution beyond this requires our consent. Your own vocabulary remains yours.

7. Coins, medals and the shop

Coins, medals, points and shop items for the robot are game elements. They have no monetary value, cannot be exchanged for money, cannot be transferred and are non-refundable. They are earned solely through learning and are lost along with the account if it is deleted. There are no purchases made with real money within the app.

8. Availability and changes to the service

We endeavour to ensure the service runs smoothly, but cannot guarantee constant availability. Maintenance, disruptions and service provider outages are possible. If we discontinue the service, we will give advance notice in the app or on the website.

9. Liability

We accept unlimited liability in cases of wilful misconduct and gross negligence, in the event of injury to life, limb or health, and under the Product Liability Act. In cases of simple negligence, we are liable only for the breach of a fundamental contractual obligation – that is, an obligation on which you are particularly entitled to rely when using the app – and only for typical, foreseeable damage. Otherwise, liability is excluded. This also applies to our agents.

We cannot promise learning success or grades. We accept no liability for the accuracy of vocabulary that users enter themselves, import or receive from a class.

10. Deleting the account and blocking access

You can delete your account, including all data, at any time: in the parents’ area of the app under ‘Delete account’ or via the contact form (select ‘Delete account’ as the subject). We may suspend or delete an account if someone seriously or repeatedly breaches these terms and conditions, or if the service is discontinued.

11. Amendments to these terms and conditions

We may amend these terms and conditions, for example if new features are introduced or the legal situation changes. In the event of significant changes, we will notify you within the app or on the website and seek your consent. If you do not agree, you may delete your account.

12. Data Protection

Our approach to data is set out in the privacy policy.

13. Final provisions

German law applies. If you are a consumer, you remain entitled to the mandatory consumer protection regulations of the country in which you live. Should any provision be invalid, the remaining provisions shall remain valid. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
